Quotations: all service quotations are valid for 30 days unless otherwise specified. Payment: invoices are payable within 30 days from the invoice date. Late payments may incur interest charges.
5. Customer Obligations
The Customer agrees to provide accurate and complete information about the Goods, ensure proper packaging and labeling of Goods, and comply with all applicable laws and regulations.
6. Liability and Limitations
Company Liability: CW Express Shipping's liability for loss or damage to Goods is limited to the lesser of the actual value of the Goods or $100 per shipment, unless a higher value is declared and additional charges are paid. Force Majeure: the Company is not liable for delays or failures due to causes beyond its control, including natural disasters, acts of government, or labor disputes.
7. Claims and Disputes
Claims: all claims for loss or damage must be submitted in writing within 30 days of delivery. Dispute Resolution: any disputes arising from these terms shall be resolved through mediation or arbitration in the state of Illinois, in accordance with Illinois laws.
8. Insurance
The Company does not provide insurance coverage for Goods. Customers are advised to obtain their own insurance.
9. Governing Law
These terms and conditions are governed by the laws of the state of Illinois.
10. Amendments
The Company reserves the right to amend these terms and conditions at any time. Changes will be communicated to the Customer in writing.
11. Entire Agreement
These terms constitute the entire agreement between the Company and the Customer, superseding all prior agreements or understandings.
12. Severability
If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in effect.
